Zoning, Land Use, and Condemnation Law

Given the growth that North Carolina has experienced over the past decade, one of the fastest growing areas of the law involves zoning, land use, and condemnation. Local governments have adopted numerous zoning and subdivision controls to govern this growth, and state agencies such as the Department of Environment and Natural Resources all regulate development. In some instances, action by the local and state government may constitute a violation of a property owner’s rights that are protected by law. However, enforcement of these rights can often involve a series of administrative hearings and appeals and then may ultimately find their way into the court system.
Jim Scarbrough and Jim DeMay routinely represent their clients in zoning, land use, and condemnation matters against local and state government at both the trial and appellate level. Our firm will challenge government action based upon land use controls, zoning ordinances, nonconforming uses, and determination of fair compensation for the taking of property.
