How do you obtain an absolute divorce in North Carolina?

ANSWER:

In North Carolina, there are essentially two ways to obtain a divorce. The primary and most common method is to obtain a North Carolina divorce after you have lived continuously separate and apart for one year. The other way is to prove incurable insanity. The largest percentage of divorces in fact is obtained after the parties have lived continuously separate and apart for one year. The procedure is to file a Complaint and Summons and serve upon the opposing party. They have thirty (30) days in which to file an answer or other responsive pleading. If no response is filed, then the case can be calendared and divorce promptly entered. Unless there is objection, in Cabarrus County, North Carolina, the divorce can be obtained by your attorney without the necessity for you to be present.
